Welcome to RHM Planning and Estate Liquidation Services (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our estate planning, estate liquidation, and estate sale services, including our website and any related offerings (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Services, you affirm that you are at least 18 years of age and legally authorized to act on behalf of an estate, trust, or as a private individual engaging our services. If you do not agree to these Terms, you may not use our Services.
2. Scope of Services
RHM Planning and Estate Liquidation Services offers a combination of professional services, which may include:

Inventory, valuation, and liquidation of estate assets including real estate, personal property, vehicles, and financial instruments

Full or partial estate sale organization, management, and cleanup

We reserve the right to modify or discontinue any part of the Services at any time.
3. Client Responsibilities
Clients agree to:

Provide accurate legal authority to act on behalf of an estate or trust if applicable

Grant physical access to property and items relevant to the estate sale or liquidation

Disclose all known liens, encumbrances, and legal issues related to the estate or property

Maintain communication throughout the process and make timely decisions when needed
Failure to do so may result in delayed services or termination of the engagement.
4. Fees and Payment Terms
Payment for Services will be agreed upon in a separate written engagement letter or service agreement. Typical fee structures may include:

Flat fees for estate planning services

Commission-based fees for estate sales and liquidations

Hourly or project-based billing for specialized services
Late payments may incur a 10% late fee per month. We reserve the right to withhold final reports, proceeds, or transfer of assets until outstanding balances are settled.
5. Ownership and Handling of Property
All items left in our care for liquidation or sale are handled with professional diligence. We do not assume ownership of any estate property unless explicitly agreed upon in writing. Clients must provide clear documentation proving rightful authority to liquidate or sell property.
We are not liable for items lost or damaged due to unforeseen circumstances such as theft, natural disasters, or pre-existing defects.
6. Intellectual Property
All materials, forms, reports, digital content, and marketing media created by RHM Planning and Estate Liquidation Services remain our intellectual property. You may not reproduce, repurpose, or distribute any such materials without express written permission.
7. Disclaimers
We provide our Services “as is” and make no guarantees regarding the financial outcomes of estate sales or valuations. Market values fluctuate, and sale prices may vary based on timing, demand, condition, and other external factors.
We do not offer legal or tax advice unless explicitly stated in a written agreement.
8. Limitation of Liability
To the fullest extent permitted by law, RHM Planning and Estate Liquidation Services shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits, arising out of or related to your use of the Services.
Our total liability for any claim will not exceed the total amount paid by you for the Services provided.
9. Indemnification
You agree to indemnify, defend, and hold harmless RHM Planning and Estate Liquidation Services, its agents, employees, and contractors from any claims, liabilities, losses, or damages arising from your breach of these Terms or misuse of the Services.
10. Termination of Services
We reserve the right to terminate or refuse Services if a client becomes uncooperative, provides false information, or fails to meet agreed payment obligations.
Termination does not relieve the client of payment for services already rendered or costs incurred.
11. Governing Law
These Terms are governed by and construed under the laws of the State of [Insert State, e.g., Nevada], without regard to conflict of law principles. All legal proceedings shall be brought in the appropriate courts of that jurisdiction.
12. Changes to Terms
We may update these Terms at any time. If we make material changes, we will notify you by posting the revised Terms on our website. Continued use of our Services constitutes acceptance of the updated Terms.
